Additional Comments: I saw it in the previews.  What is the point of that?  Are they going to make it so Luke and Noah can't be together?

If there was a need to ''adopt'' Noah, then since Luke is an adult himself, he could have done it.   There were cases of that happening especially back in the 80s prior to the move for civil unions, domestic partnerships, etc. when gays needed a legal remedy to make their partner their heir, or create a family relationship so that other civil matters such as health care decisions could be made.

How would this prevent them from being together?  The main reason for that applying to brothers/sisters is biology & these two were a couple for a long time before this came up.  They weren't raised as siblings, they were a 'romantic' couple (I use the term loosely) long before even a discussion of adoption came up.  IRL we've seen adoptive siblings marry, because they weren't biologically related & in most of those cases, they also weren't raised as siblings.

  • Illinois law forbids marriage between adoptive brother and sister, and a common definition of ''incest'' is ''sexual intercourse between persons who are too closely related to marry legally,'' so the continuation of Luke/Noah's physical relationship would be analogous to incest.
  • I doubt the sex police are going to bust into their house and arrest them.
  • Yes, but that means that the state recognizes gay marriage. Iowa does, but I don't recall hearing that Illinois does. In states that don't recognize same sex marriage or unions either between same sex couples or older couples, as an adoptive sibling, Luke & Noah would have more rights--like to see each other in the hospital. eom
  • Well since Illinois law doesn't allow same-sex marriage that point is moot. And as Damian said, there is no blood relation, so there is no biological incest. Two gay men can father a baby together anyway. That's what incest laws attempt to prevent between straight people. - Ty
  • Correction: My line above should read: ''Two gay men CAN'T father a baby anyway.'' .. Of course, you all knew that already, right? LOL! - Ty
